- publishing defamatory and/or knowingly false material about Avakia Data Despatch, your colleagues and/or our customers on social networking sites, ‘blogs’ (online journals), ‘wikis’ and any online publishing format
- undertaking deliberate activities that waste staff effort or networked resources

If you produce, collect and/or process business-related information in the course of your work, the information remains the property of Avakia Data Despatch. This includes such information stored on third-party websites such as webmail service providers and social networking sites, such as Facebook and LinkedIn.
Monitoring
Avakia Data Despatch accepts that the use of the internet is a valuable business tool. However, misuse of this facility can have a negative impact upon employee productivity and the reputation of the business.
In addition, all of the company's internet-related resources are provided for business purposes. Therefore, the company maintains the right to monitor the volume of internet and network traffic, together with the internet sites visited. The specific

Use of email by employees of Avakia Data Despatch is permitted and encouraged where such use supports the goals and objectives of the business.
However, Avakia Data Despatch has a policy for the use of email whereby the employee must ensure that they:
- comply with current legislation
- use email in an acceptable way
- do not create unnecessary business risk to the company by their misuse of the internet
Unacceptable behaviour
- use of company communications systems to set up personal businesses or send chain letters
- forwarding of company confidential messages to external locations
- distributing, disseminating or storing images, text or materials that might be considered indecent, pornographic, obscene or illegal
- distributing, disseminating or storing images, text or materials that might be considered discriminatory, offensive or abusive, in that the context is a personal attack, sexist or racist, or might be considered as harassment
- accessing copyrighted information in a way that violates the copyright
- breaking into the company’s or another organisation’s system or unauthorised use of a password/mailbox
- broadcasting unsolicited personal views on social, political, religious or other non-business related matters
- transmitting unsolicited commercial or advertising material
- undertaking deliberate activities that waste staff effort or networked resources
- introducing any form of computer virus or malware into the corporate network
Monitoring
Avakia Data Despatch accepts that the use of email is a valuable business tool. However, misuse of this facility can have a negative impact upon employee productivity and the reputation of the business.
In addition, all of the company’s email resources are provided for business purposes. Therefore, the company maintains the right to examine any systems and inspect any data recorded in those systems.
In order to ensure compliance with this policy, the company also reserves the right to use monitoring software in order to check upon the use and content of emails. Such monitoring is for legitimate purposes only and will be undertaken in accordance with a procedure agreed with employees.
Sanctions
Where it is believed that an employee has failed to comply with this policy, they will face the company's disciplinary procedure. If the employee is found to have breached the policy, they will face a disciplinary penalty ranging from a verbal warning to dismissal. The actual penalty applied will depend on factors such as the seriousness of the breach and the employee's disciplinary record.
Agreement
All company employees, contractors or temporary staff who have been granted the right to use the company’s email services are required to sign this agreement confirming their understanding and acceptance of this policy.
Contract:
“System Software” means “All Files photos, pictures, database, folders & Domain names”
“The Package” means “the Website side and Administration side & Email Account”
Our “System Software” including All Files, photos, pictures, database, folders & Domain names will always remain the property of Avakia Data Despatch at all times.
What do you get?
You will have the right to use our system at all time as long as your monthly fees paid by direct debit are made without interruption.
The use of “The Package” by you includes the Full use of the website side and the administration side and Email Accounts.
All Domain names and Sub-Domains we provide you will remain the property of Avakia Data Despatch, and we have the right to transfer the domain name or re-license the use of it, any time after your payment by direct debit for “The Package” stops for any reason.
You have the right to cancel your contract at any time, you will be charged the full amount for that current month only.
If you have your own domain name and you would like to use it with “The Package”, the domain name will always remain your property, and you can re-transfer it back at any time without content.
Fee:
In consideration for the services and products Licensed to You and provided to You by Avakia Data Despatch, You agree to pay Avakia Data Despatch at the time service is provided. Payment is to be made by you by providing one of the following: a valid credit card for first monthly instalment, and by Direct Debit thereafter, Payments are non-refundable. If for any reason Avakia Data Despatch is unable collect payment by Direct Debit for the full amount owed to Avakia Data Despatch for the service provided, or if Avakia Data Despatch is charged a penalty for any fee it previously charged to Your Payment Method, You agree that Avakia Data Despatch may pursue all available remedies in order to obtain payment. You agree that among the remedies Avakia Data Despatch may pursue in order to effect payment, shall include but will not be limited to, immediate cancellation without notice to you of any domain names registered or renewed on your behalf. Avakia Data Despatch reserves the right to charge a reasonable service fee for administrative tasks outside the scope of its regular services. These include, but are not limited to, customer service issues that cannot be handled over email but require personal service, and disputes that require legal services. These charges will be billed to the Payment Method we have on file for you.
